Charges Stand

Charges against a man who led local authorities on a high speed chase will stand, even though officers failed to bring him in front of an Iowa magistrate before returning him to Wisconsin. The Telegraph Herald reports the case involves 29-year old Anthony Garbacz Junior, who led authorities on a chase on April 1st 2015 from Prairie Du Chien into Clayton County. An appeals judge found that Prairie Du Chien Officer Anthony Berg failed to bring the suspect before an Iowa magistrate to determine if the arrest was lawful. The judge added that the mistake however, did not represent a due-process violation. Garbacz Junior was found guilty of misdemeanor resisting arrest and sentenced to one-year supervised release.
