Lawsuit Dismissed

A lawsuit against the city of Prairie Du Chien and the School District filed by the parents of a 4-year old who drowned has been dismissed.  The Telegraph Herald reports that the suit was filed by Kurt Warrington Junior and Rachel Warrington after their 4-year old son, Kashton, died after being found unresponsive during a swimming lesson.  The incident occured back on August 2nd of last year.  Judge Craig Day ruled that the case was a "textbook" claim of "recreational immunity," referring to the statute that protects property owner's liability in connection with recreational activity.
